Nicholas Elliot - Litigation and general practice

He obtained his LLB in 2007 and completed his articles in a prestigious Johannesburg based law firm, Schindlers Attorneys, where he obtained a huge amount of experience in MVA, personal injury and RAF matters. He was involved in many litigious matters in both the High and Magistrates Courts. Further in his training with Schindlers Attorneys he gained experience in competition litigation and landlord and tenant disputes.

After his articles had expired Nicholas wanted to gain further experience in other aspects of the law and joined Cyril Ziman and Associates where he gained further experience in general law, litigation and liquidations. Nicholas again felt that he needed to gain more experience and joined TLi Incorporated.

Soon after joining TLi Inc that Nicholas was satisfied that he has the necessary competence, experience and training to start on his own, ran the litigation and general practice department of Louis De Villiers Attorneys and now as a director of Thomson Wilks Inc.

Employers should scrutinise their pay practices to ensure that disparities in remuneration are objectively justifiable and are not grounds for claims of #unfair #discrimination.
This follows the inclusion of section 6(4) in the #Employment #Equity #Act which now expressly accommodates claims of equal pay for work of equal value in the general prohibition against unfair employment discrimination.
The date on which this amendment will take effect is, however, still to be determined by the President.
Section 6(4) provides that a difference in the terms of employment between employees of the same employer performing substantially the same work or work of equal value that is based on any of the grounds listed in section 6 (1) of the Act (for example, race, gender, age, language and sexual orientation) or any other impermissible arbitrary ground is unfair discrimination.
